Terms & Conditions
Last updated: 5 September 2026
These terms cover the web design and development services provided by caleb.rocks - the freelance service operated by Caleb Bruce Whittaker, sole trader (ABN 62 866 297 258), based on the Granite Belt, Queensland, Australia ("I", "me", "my"). By engaging my services you agree to them. They're written to be read, not decoded.
Quotes and scope
Every project starts with a free chat and a written quote. Quotes are valid for 30 days and state the agreed scope - pages, features, and what's included in the chosen package (Essential or Signature). Work outside the agreed scope is quoted separately before it's done, so there are no surprises on the invoice.
Accepting a project
A project begins when you accept the written quote or proposal and the required deposit has been received. The quote, agreed scope and these terms together form the agreement for the project. If there is any conflict, the written quote or proposal takes priority for project-specific details.
Payment
Projects are invoiced in Australian dollars; invoices will state any applicable GST. Payment is 50% deposit before work begins and 50% after final approval, before the site goes live. The final domain cutover and launch don't happen until the final payment is received. Domain registration and other third-party costs are billed at cost. Bank transfer is the usual payment method. Website Care is A$69/month (or A$199/quarter), billed in advance, and can be cancelled anytime - it runs to the end of the paid month. Work outside a package or Care plan is charged at A$95/hour in 30-minute increments, or quoted for larger pieces.
Cancellation
You can cancel a project at any time by letting me know in writing. If you cancel after work has begun, amounts already paid may be retained to cover work completed, time reserved and reasonable costs incurred up to the date of cancellation. If the value of work completed exceeds the amount already paid, I may invoice the difference. Any amount paid for work that has not been performed or costs that have not been incurred will be dealt with in accordance with applicable law.
Client delays and inactive projects
Project timelines rely on you providing content, access and feedback when reasonably requested. Delays on your side may move the delivery date. If a project is inactive for more than 30 days because required material or feedback has not been provided, I may pause the project and reschedule the remaining work. If it remains inactive for more than 60 days, I may close the project and invoice for work completed to that point. Restarting a closed project may require a new timeline or quote.
Revisions
Each package includes the revision rounds stated on the pricing page (two for Essential, three for Signature). A revision round is consolidated feedback on the current design - not a new direction. Beyond the included rounds, extra revisions are charged at the hourly rate or quoted before proceeding.
Timelines
Timelines are agreed in the quote and depend on photos, content and feedback arriving when promised. If something on your side delays things, no stress - the timeline just shifts accordingly, and I'll keep you posted.
Your content and responsibilities
You are responsible for checking the accuracy, legality and suitability of information you provide or approve, including names, prices, claims, licences, opening hours, photographs and contact details. You confirm that you have the necessary rights or permission to use content you supply. I may flag apparent issues, but I am not responsible for independently verifying your business claims or legal compliance unless specifically agreed.
Concept redesigns
The concept redesigns shown on this site are speculative works I created to demonstrate my standard of work. They are not client commissions, and the businesses named have not necessarily engaged me. Pre-engagement concept work remains my intellectual property until a project is agreed and paid for.
Who owns what
Once all project invoices are paid in full, you receive ownership of the client-specific content and original design work created specifically for your project, together with the right to use the finished website for your business. I retain ownership of my pre-existing code, reusable components, development methods, templates, utilities and general know-how. Third-party software, fonts, images, libraries and other licensed materials remain subject to their original licences. Where reusable or third-party material forms part of the finished site, you receive the rights necessary to use it as part of that website. I may display the finished work in my portfolio unless we agree otherwise in writing.
Third-party services
Websites may rely on third-party services such as domain registrars, hosting providers, email services, form processors, analytics platforms, map providers or other integrations. Those services operate under their own terms, pricing and availability. I will take reasonable care when configuring them, but I do not control and cannot guarantee the continued availability, pricing, compatibility or performance of third-party services.
Warranties and liability
I provide services with reasonable care and skill. Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. Subject to those rights, I am not responsible for loss caused by matters outside my reasonable control, including third-party outages, unauthorised changes made by others, compromised client accounts, domain or email provider failures, or use of the website in a way it was not designed for. To the extent permitted by law, I am not liable for indirect, incidental or consequential loss.
Search engines and business results
Where SEO foundations, Search Console or similar services are included, I will implement the agreed technical and on-page work with reasonable care. I do not guarantee search rankings, traffic levels, enquiries, sales or any other particular business result, as these depend on factors outside my control.
Browser and device compatibility
Websites are tested against current mainstream browsers and common screen sizes at the time of delivery. I do not guarantee identical appearance or functionality on obsolete browsers, unsupported devices or future software versions.
Domains, accounts and backups
Wherever practical, domains and business-critical third-party accounts remain in your ownership and control. You are responsible for maintaining access to your domain registrar, email and other accounts after handover. I may retain working copies or backups for a reasonable period, but unless a separate maintenance or backup service is agreed, I do not promise indefinite storage of project files or website backups.
Changes to these terms
If these terms change, the date at the top of this page changes with them. The terms that apply to a project are the ones current when the quote was accepted.
